Welcome to HomeCareBilling, a service operated by eCommerce Friendly, LLC (“we,” “our,” or “us”). HomeCareBilling is the brand name under which eCommerce Friendly, LLC operates this Colorado Medicaid billing automation service. By using our service, you agree to these terms. Please read them carefully.
1. Service Description
HomeCareBilling provides Medicaid billing automation software for home care agencies in Colorado. Our service includes:
- Upload and validation of claim data
- Generation and submission of 837P electronic claims to Colorado HCPF
- Processing and reconciliation of 835 payment remittance files
- Payment tracking and reporting
2. Trading Partner Authorization
2.1 Our Role as Billing Agent
eCommerce Friendly, LLC (operating as HomeCareBilling) is a registered Trading Partner with the Colorado Department of Health Care Policy and Financing (HCPF). We are authorized to submit 837P electronic claims on behalf of enrolled providers through HCPF’s fiscal agent, Gainwell Technologies.
Important: HomeCareBilling is a billing agent, not a payer. We facilitate the submission of your claims to Colorado Medicaid, but all payment decisions are made by HCPF. Claim acceptance by our system does not guarantee payment.
2.2 Provider Authorization Required
Before we can submit claims on your behalf, you must authorize HomeCareBilling as your billing agent through the Colorado Provider Web Portal:
- Log in to the Provider Web Portal
- Navigate to Manage Accounts
- Add our Trading Partner ID (TPID) as a Registered Billing Agent
- Select the appropriate submission permissions
This authorization is required by HCPF and establishes the legal relationship that allows us to submit claims on your behalf.
2.3 Your Responsibilities
As the provider, you are solely responsible for:
- The accuracy and completeness of all claim data you submit through our service
- Ensuring services were actually provided as documented
- Compliance with all Colorado Medicaid billing rules and regulations
- Maintaining proper documentation to support submitted claims
- Responding to any audits or inquiries from HCPF regarding your claims
2.4 Our Responsibilities
HomeCareBilling is responsible for:
- Transmitting your claims accurately to HCPF via secure electronic data interchange (EDI)
- Validating claim format and structure before submission
- Retrieving and presenting payment remittance (835) information
- Maintaining the security and confidentiality of your data
3. Account Terms
3.1 Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials.
3.2 Account Requirements
- You must be a licensed home care agency in Colorado
- You must have a valid NPI (National Provider Identifier)
- You must have a valid Tax ID (EIN)
- You must be at least 18 years old
3.3 Account Security
You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.
4. Payment Terms
4.1 Subscription Fees
- Subscription fees are billed monthly or annually based on your selected plan
- All fees are non-refundable except as required by law
- We may change pricing with 30 days advance notice
4.2 Free Trial
- New accounts may be eligible for a free trial period
- Payment information may be required to start a trial
- Your subscription will begin automatically unless canceled before the trial ends
4.3 Payment Processing
- Payments are processed through Stripe
- You authorize us to charge your payment method for subscription fees
- Failed payments may result in service suspension
5. Cancellation and Termination
5.1 Cancellation by You
- You may cancel your subscription at any time through your account settings
- Cancellation takes effect at the end of your current billing period
- You retain access until the end of your paid period
5.2 Termination by Us
We may suspend or terminate your account if you:
- Violate these terms
- Fail to pay subscription fees
- Engage in fraudulent activity
- Submit false or misleading claims
5.3 Effect of Termination
Upon termination:
- Your access to the service will be revoked
- Your data will be retained for 90 days, then deleted
- You remain responsible for any outstanding fees
6. Data Handling
6.1 Your Data
You retain ownership of all data you submit to HomeCareBilling. We process your data solely to provide our services.
6.2 Data Security
We implement industry-standard security measures including:
- Encryption of data in transit and at rest
- Regular security audits
- Access controls and monitoring
6.3 HIPAA Compliance
As a covered entity under HIPAA, we maintain appropriate safeguards for Protected Health Information (PHI). See our Privacy Policy for details.
6.4 Data Export
You may export your data at any time through the application interface.
7. Liability Limitations
7.1 Warranty Disclaimer
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT CLAIMS WILL BE ACCEPTED OR PAID BY MEDICAID.
7.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMECAREBILLING SHALL NOT BE LIABLE FOR:
- Indirect, incidental, or consequential damages
- Lost profits or revenue
- Claim denials or payment delays by payers
- Data loss due to circumstances beyond our control
7.3 Maximum Liability
Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Governing Law
These terms are governed by the laws of the State of Colorado. Any disputes shall be resolved in the state or federal courts located in Denver, Colorado.
9. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or through the application. Continued use after changes constitutes acceptance.
